The agreement, written to be read.

This is the agreement between you and Tucker Timothy. We have written it in plain language because you should be able to understand what you are agreeing to without a lawyer.

What Tucker Timothy does

You text photos and messages to a phone number. We keep them. When you want a book, we build one from what you sent and have it printed and delivered.

There is no app to install and no account for the people who text you photos. You are the only one who needs an account.

Who can use it

You must be 18 or older and live in the United States. Tucker Timothy is not available elsewhere yet.

Your photos stay yours

You give us permission to store your photos, assemble them into a book, and send that book to our printing partner so it can be printed and delivered. That permission exists so we can do the job you asked for, and it ends when you delete the material or close your account.

By sending us a photo you confirm you have the right to do so, and the right to have it printed.

What you may not send

Anything unlawful, anything that infringes someone else's rights, and above all any sexual content involving a minor. We report child sexual abuse material to the authorities without exception and close the account permanently.

Books, prices and delivery

Pricing

You see the exact price before you order. Nothing is ever charged automatically for a book you have not approved.

You choose when it arrives

You tell us the date you want your book in your hands and we work backwards from it. We do not pick a date for you, and there is no assumed holiday deadline.

If a date is at risk we will tell you in advance and agree a new one with you. A late gift is worse than a book that was always going to arrive later.

Once a book is printing

A book is made for you and only you, so once printing has begun it cannot be cancelled or changed. We will tell you clearly when that point arrives.

If something is wrong with it

If your book arrives damaged, misprinted or incorrect through our fault, tell us within 30 days and we will reprint it at no charge. We do not ask you to send the first one back.

Subscriptions

If you pay monthly, those payments are not refundable, and every payment you make counts as credit toward the printing of your book. Credit is held for 12 months from your most recent payment.

If you pay for a year in advance you pay less. You can cancel at any time and your collection stays where it is — cancelling stops future payments, it does not delete your photos.

We will email you before any renewal charge. We will never charge you a renewal without telling you first.

Text messages

Tucker Timothy works by text message. By texting our number, or by asking us to set up a collection for your number, you agree to receive messages from us about your collection and your books.

Reply STOP to stop. Reply HELP for help. Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages.

Deleting things

You can delete any memory, or your whole account, whenever you like. See our privacy policy for exactly what happens and how long it takes.

A book already printed cannot be unprinted. Deleting a photo does not change a book on your shelf.

Keeping your books printable

We store the recipe for every book you order — which photos, in what order, laid out which way — so that a book can be reprinted years later and come back the same. We intend to keep that true for as long as Tucker Timothy exists.

If we ever shut down, we will give you at least 90 days' notice and a way to download everything you have given us, including full-resolution photographs.

What we do not promise

Tucker Timothy is a small company. We work hard to keep your photos safe, and we use established providers for storage and backups, but no service should be your only copy of something irreplaceable. Please keep your own backup of photographs that matter to you.

The service is provided as it is. We cannot promise it will never be unavailable or never make a mistake. Where the law allows us to limit our liability, our total liability to you is limited to what you have paid us in the previous 12 months.

Nothing here limits liability for anything the law does not permit us to limit.

Ending the agreement

You can stop at any time by closing your account. We may close an account that breaks these terms, and if we do we will tell you why and refund anything you have paid for a book not yet printed.

Disagreements

Tell us first — kira@tuckertimothy.com. Most things are fixable by someone reading the message and sorting it out.

These terms are governed by the laws of the Commonwealth of Pennsylvania, and any dispute that cannot be resolved between us will be handled by the courts of Pennsylvania.

Changes

If we change these terms in a way that matters, we will email you before the change takes effect.
